Diabetic bus driver wins £60k for unfair dismissal

A bus driver in London was awarded close to £60,000 following a successful unfair dismissal claim.

David Hoggett was employed by Abellio London Limited, and after being diagnosed with Type 2 diabetes in April 2012 had to make a number of claims for sick pay from his employer. Diabetes is recognised as a disability under the Equality Act 2010.

Mr Hoggett was prescribed Vitamin D medication and tried to return to work but suffered a setback and was signed off again.

He was eventually dismissed in July 2012 on medical grounds and that he was incapable of carrying out his duties as a bus driver.

Mr Hoggett took his employer to an employment tribunal on grounds of unfair dismissal and disability discrimination. He won his case and was awarded £10,000 compensation for “injury to feelings” and also close to two years of salary, some £47,000.
